6. Description of the contract

The purpose of this contract is to carry out the construction works for the Restoration and musealization of the Photography Gallery ‘Marubi’. The works will include the restoration/rehabilitation of the existing building and the construction of new space next to the existing one. The contract is foreseen under ‘Sustainable tourism management of Adriatic Heritage [HERA] project. The project is implemented in the context of IPA Adriatic Cross-border Cooperation Programme 2007-2013.
The main project objective is the enhancement and promotion of cultural, architectural and historical values of the Albanian heritage. Through this project, it is aimed at transforming “Marubi” National Photo Gallery into a contemporary cultural institution by establishing new standards of its functioning and management.
Project Implementation aims at restoring and musealization of the Marubi Photo Gallery which is expected to revitalize the cultural tourism in Shkodër city and be used by scholars and relevant professionals for educational purposes.
The period of implementation of the works contracts will be 9 months followed by the defects liability period of 12 months.

8. Eligibility and rules of origin

Participation is open to all legal persons participating either individually or in a grouping (consortium) of tenderers which are established in a Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the programme under which the contract is financed (see item 22 below). All goods supplied under this contract must originate in one or more of these countries. Participation is also open to international organisations. Participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed.


9. Grounds for exclusion

Tenderers must submit a signed declaration, included in the Tender Form for a Works Contract, to the effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to Contract Procedures for EU External Actions (PRAG).


10. Number of tenders

Tenderers may submit only one tender per lot. Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than one lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the works required in the tender dossier.


11. Tender guarantee

Tenderers must provide a tender guarantee of 20,000 euros when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties.


12. Performance guarantee

The successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract at the signing of the contract. This guarantee must be provided together with the return of the countersigned contract no later than 30 days after the tenderer receives the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next cheapest compliant tender.


13. Information meeting and/or site visit

No information meeting is planned.


14. Tender validity

Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.


15. Period of implementation of tasks

- 9 months from the commencement date, plus 12 months of Defect Liability Period




16. Selection criteria

The selection criteria for each tenderer are as follows:


1. Economic and financial capacity of candidate:

a) The average annual turnover of the tenderer in the past 3 years (2011, 2012 and 2013) must be at least EUR 2,500,000. If the turnover is not submitted in euro, the exchange rate applied is the average exchange rate of the year concerned in accordance with the Infor€uro (http://ec.europa.eu/budget/inforeuro/). For Albanian Lek the Euro average exchange rate is 1 Euro: 140.184 ALL in year 2011 and 138.928 ALL in year 2012, 140.282 ALL in year 2013.

b) The tenderer must have access to sufficient credit and other financial facilities to cover the required cash-flow for the duration of the contract. In any case, the amount of credit available must be at least EUR 300,000.


2. Technical and professional capacity of candidate:

a) The tenderer must have successfully completed as a prime contractor (i.e. sole contractor or lead member of a joint venture/consortium), between January 2010 and the tender submission deadline, at least 3 (three) works contracts from which, (i) 1 (one) contract for construction/reconstruction of public buildings for a value of at least EUR 1,000,000 (without VAT), and (ii) 1 (one) contract of works for conservation/ restoration/ rehabilitation of buildings of similar nature and complexity for a value of at least EUR 100,000.00 (without VAT), and (iii) 1(one) contract of works for restoration/conservation and musealization of muséums for a value of at least EUR 500,000.00 (without VAT).
In case of a joint venture/consortium, the lead member must have successfully completed 1 (one) works contract for construction/reconstruction of public buildings for a value of at least EUR 1,000,000 (without VAT) and 1 (one) works contract in line with the criteria set up under 2 a (ii) or 2 a (iii) , while the joint venture/consortium as a whole should comply with 100% of above mentioned criteria 2a).
The tenderer must submit copies of the respective Certificates of Provisional Acceptance, Taking Over Certificates or similar signed by the supervisor/contracting authority of the projects concerned, and if necessary duly translated into English.

b) The tenderer must propose and have available for the implementation of the contract (Form 4.6.2 Plant) at least the following machineries and equipment:

c) The tenderer, or any member of the joint venture/consortium (in case of joint venture/consortium), or any eligible subcontractor (declared at the tender phase) possesses licence for restauration works issued by the Albanian Ministry of Culture, in accordance with the Albanian Law of the Cultural Heritage No.9048 date 07 April 2003.


d) The minimum total number of permanent personnel for the technical staff as Engineers, Surveyors and Foremen in accordance with Form 4.6.1 currently employed by the tenderer must be at least 50 (fifty) (proof of social contribution and/or insurance must be provided).


e) The candidate's key personnel (Form 4.6.1.2 and Form 4.6.1.2) must be composed of the following profiles:


One (1) Project Director/ Contractor’s Representative:
He/she will manage the works contract and will act as contractor's representative.
He/she must fulfil the following criteria:


  • University degree in civil engineering or architecture;
  • Have at least 10 years of proven professional experience in implementation of works contract related to building construction.
  • Possess proven experience as Contractor's Representative having managed and successfully completed between January 2010 and the tender submission deadline at least 1 (one) works contract for construction and/or reconstruction and/or rehabilitation of public buildings, with a value of at least EUR 1,000,000 (without VAT) (supporting documentation uch as Copies of Signed Provisional Acceptance, Taking Over Certificate or Similar must be provided).
  • Proven experience as Contractor’s Representative of minimum one construction contract based on PRAG or FIDIC conditions
  • Possess a very good level of English (i.e. corresponding to level 1 or 2 in form 4.6.1.3);
  • Be permanent employee (more than 6 months with tenderer) of the tenderer or of Lead member in case of a Consortium (proof of social contribution and/or insurance must be provided).

One (1) Site Engineer:
He/she will be in charge of all organisation, logistics and works' execution of the site. He/she shall be present on site full time. The proposed candidates should fulfil the following criteria:


  • Possess a university degree in civil engineering or architecture;
  • Have at least 10 years of proven professional experience as site engineer in the field of construction and/or restoration and/or rehabilitation of buildings.
  • Possess proven experience as Site Engineer having managed and successfully completed between January 2010 and the tender submission deadline at least 1 (one) works contract for construction/reconstruction of public buildings, with a value of at least EUR 1,000,000 (without VAT) (supporting documentation such as Copies of Signed Provisional Acceptance, Taking Over Certificate or Similar must be provided).
  • Possess proven experience as Site Engineer having managed and successfully completed between January 2010 and the tender submission deadline at least 1 (one) works contract for conservation/restoration/rehabilitation of similar buildings. (supporting documentation such as Copies of Signed Provisional Acceptance, Taking Over Certificate or Similar must be provided).
  • Be permanent employee (more than 6 months with tenderer) of the tenderer (proof of social contribution and/or insurance must be provided).
  • Possess a good level of English (i.e. corresponding to levels 1 or 2 in form 4.6.1.3).

One (1) Electrical Engineer:


  • Possess a university degree in electrical engineering;
  • Have at least 5 years of proven professional experience as electrical engineer in implementation of works contracts in the field of construction and/or rehabilitation of buildings.
  • Possess proven experience as Electrical Engineer having managed and successfully completed between January 2010 and the tender submission deadline at least 1 (one) works contract for construction and/or rehabilitation of buildings, with a value of at least EUR 500,000 (without VAT) (supporting documentation such as Copies of Signed Provisional Acceptance, Taking Over Certificate or Similar must be provided).
  • Possess a good level of English (i.e. corresponding to levels 2 or 3 in form 4.6.1.3).

One (1) Quality Surveyor:


  • Possess a university degree in civil engineering or equivalent;
  • Have at least 5 years of proven professional experience as quality surveyor in implementation of works contracts.
  • Possess proven experience as Quality Surveyor having managed and successfully completed between January 2010 and the tender submission deadline at least 1 (one) works contract for construction and/or rehabilitation of buildings, with a value of at least EUR 500,000 (without VAT) (supporting documentation such as Copies of Signed Provisional Acceptance, Taking Over Certificate or Similar must be provided).
  • Possess a good level of English (i.e. corresponding to levels 2 or 3 in form 4.6.1.3).

For each period of experience mentioned in the CV the starting and ending date must be clearly given, mentioning both the month and the year (e.g. 03.2007 – 09.2009). The Contracting Authority reserves the right to verify the content of the CVs and the professional experience presented for the different posts, asking during the tender evaluation additional documents that shall prove such required experience. CVs not fulfilling through evidence all the requirements will lead to the rejection of the tender. The Contracting Authority reserves as well the right to verify through interviews the level of English of the Project Director/Contractor's Representative and the Site Engineer prior to the signature of the contract.


a. In case of tender submitted by a joint venture/consortium the lead member must satisfy at least 60 % of the requirements set under criteria 1 (a), 1 (b) and 2 (d).


b. Each partner of a joint venture/consortium (i.e not the lead member submitting the tender must satisfy at least 30 % of the the requirements set under criteria 1 (a), 1 (b) and 2 (d).


c. The joint venture/consortium must satisfy the minimum selection selection criteria as a whole.


An economic operator may, where appropriate and for a particular contract, rely on the capacity of other entities, regardless of the legal nature of the links which it has with them. Some examples of when it may not be considered appropriate by the Contracting Authority are when the tenderer relies mostly on the capacity of other entities or when it relies on key criteria. If the tenderer relies on other entities, it must prove to the Contracting Authority that it will have at its disposal the resources necessary to perform the contract, for example by producing an undertaking on the part of those entities to place resources at its disposal. Such entities, for instance the parent company of the economic operator, must respect the same rules of eligibility and notably that of nationality, as the economic operator. Furthermore, the tender should include a separate document providing data on this third entity for the relevant selection criterion. Proof of capacity must be furnished at the request of the Contracting Authority.

The tender dossier is available from the premises of the Albanian Development Fund upon payment of 150 euro, which excludes courier delivery.

The tenderer should provide Bank’s payment receipt to the Employer. Upon receipt of appropriate evidence of payment of the non-refundable fee, the documents will be available to the Tenders.

It is also available for inspection at the premises of the Contracting Authority, address as in point 5 above. Tenders must be submitted using the standard tender form included in the tender dossier, whose format and instructions must be strictly observed.
