I. The duration and summary scope of the contract: The construction period is 8 months. The Works consist on construction, urban regeneration and upgrading works in Vlora. This contract is part of a larger scheme of Urban Acupuncture Regeneration Strategy within the city which aims to facilitate the traffic flow in the waterfront area through the construction of the ring road. Several public areas will be constructed in order to increase the assets of the Waterfront Promenade and make it more attractive to habitants’ ant tourists of any age.

The Sites are are located at city of Vlora. The contract includes works at 3 sites:
- Construction of the ring road lot II.
- Construction of four public areas along Vlora Waterfront Promenade.
- Construction of the public area opposite to Petro Marko Theatre.


II. The selection method used: The Most Advantageous Bid.


III. The Bidder submitting the successful Bid: “Gener 2” shpk. Adr. Rr. "Ppa Gjon Pali II", ABA Business Center, Kati 7, Tiranë.


IV. The Contract price of the successful Bid: 414,046,679 ALL (net of VAT) – 496,856,015.3 ALL (VAT included).

1)    JV “Riviera” shpk & “Bitupave LLC”
The bid does not meet the qualifying criteria, conforming to all the terms, conditions and specifications of the Bidding Documents as follows:
3.1 i) Financial Capabilities. “Riviera” shpk has financial capabilities from two different Banks (BKT and FiBank) in the sum of 51,100,000 ALL. “Bitupave LLC” has completed the requested form without any proof or statement of the declared liquid assets.
4.2.a) Specific Construction Experience. “Riviera” shpk, part of JV, has submitted four work contracts under Specific Construction requirement:
·         “Highway M2 – R120 of Prishtine, Kosovo”, completed between 07/2009 – 12/2015 by JV “Riviera” shpk & “Toni Com” shpk (50% “Riviera” shpk & 50% “Toni Com” shpk). The value of the works is 666,910,272 VAT excluded. The value of the work completed by “Riviera” shpk within the requested time is 222,303,424 ALL VAT excluded, which is smaller than the requirement value of 384,000,000 ALL.
·         “Reconstruction of road Tamare – Vermosh lot 1”, executed between 11/2014 – 08/2016. “Riviera” shpk is subcontractor of “Consorzio Stabile EBG”. Therefore it is not considered as Specific Construction Experience.
·         “Reconstruction of road Tamare – Vermosh lot 2”, executed between 07/2015 – 11/2016, value of works 588,367,940 VAT excluded. “Riviera” shpk is subcontractor of “Consorzio Stabile EBG”. Therefore it is not considered as Specific Construction Experience.
·         “Construction of road Tre Urat Leskovik” started in 2009 and expected to finish in 23/3/2017. The works are executed by the JV “Riviera” shpk & “Cobein” shpk and in bidding time the works haven`t finished yet. Therefore it is not considered as Specific Construction Experience. Furthermore, the value of the work completed by JV within the requested time is 360,282,011 ALL vat excluded. The value of the work completed by “Riviera” shpk is smaller than the requirement value of 384,000,000 ALL.
All supporting documents of “Bitupave LLC”, a corporation incorporated under the laws of Netherlands, part of JV, are notarized in Albania which is not in accordance with ITB 32.2.
4.2.b) Specific Construction Experience. “Bitupave LLC” hasn’t submitted IPCs to verify the declared executed volumes of woks:
·         Road construction Oost – Nederland GW/2015
·         Construction motorway Noord – Holland and Utrecht
·         Terminal Eamshaven
·         Maintenance Noor – Holland
·         Supply, Installing and renovating drinking water Noor – Holland for Velsen.
All the documents are notarized in Albania.
 
2)    JV “Curri” shpk & “Alba Konstruksion” shpk
The bid does not meet the qualifying criteria, conforming to all the terms, conditions and specifications of the Bidding Documents as follows:
3.1 ii)            Financial Capabilities. “Curri” shpk has submitted two ongoing contracts:
·         “Reconstruction of Road Poliklinika – 7 Pallatet”, value 416,132,539 ALL
·         “Ujsesjelles Cerme Terbuf”, value 453,877,195 ALL.
The value of 2015 T.O. x 1.2 factor is 1,037,737,089 ALL which is smaller than 1,100,409,734 ALL (sum of outstanding confirmed commitments works adding 60% of the contract it is bidding)
4.2.a) Specific Construction Experience.
“Curri” shpk has submitted only one similar contract “Plotesimi i segmentit "Dragobi – Valbone” with a value of 556,894,315 executed between 6/2012 and 12/2015.
The following submitted contracts are not considered as Specific Construction Experience:
·         “Reconstruction of “Libonik – Rembec – Plase” executed between 7/2013 and 09/2014. In this contract “Curri” shpk is partner by 60% in a JV. The value of the contract is 247,793,100 ALL which is smaller than than the requirement value of 384,000,000 ALL.
·         “Reconstruction of Geographic Institute building”
These works are not similar with the proposed Work as the complexity, method and nature of works (building works) are not similar as in road works.
·         “Rehabilitimi i rrethrrotullimit te Dogane – Kashar” executed between 2014 – 2015. The value of the works is 266,952,355 ALL VAT excluded. In this contract “Curri” shpk is partner by 50,42% in a JV. The value of the works executed by “Curri” shpk is smaller than the requirement value of 384,000,000 ALL.
“Alba Konstruksion” has submitted the following contracts:
·         “Reconstruction of road “Rreshen – Urake”. “Alba Konstruksion” is subcontractor of “Primorje”. Therefore it is not considered as Specific Construction Experience.
·         “Pre-trial detention Center in Elbasan”, executed between 2010–2013, value of 545,483,488 VAT included. These works are not similar with the proposed Work as the complexity, method and nature of works (building works) are not similar as in road works. Furthermore the amount of the works executed within the requested period 2012-2016 is 363,655,658 ALL which smaller than the requirement value.
·         “Reconstruction Urake – Ura e Shoshajve” executed between 2012-2014, value of 888,752,711 VAT included. “Alba Konstruksion” is subcontractor of “Impresa Grandi Struture”. Therefore it is not considered as Specific Construction Experience.
·         “Pre-trial detention center, Shkodra”, executed between 2013 – 2014, value of 1,954,517,336 ALL VAT included. These works are not similar with the proposed Work as the complexity, method and nature of works (building works) are not similar as in road works.
 
5)    JV “N.N.R. Rukolli” shpk & “Victoria Invest International”shpk
The bid does not meet the qualifying criteria, conforming to all the terms, conditions and specifications of the Bidding Documents as follows:
3.1 i) Financial Capabilities. The JV partner “Rukolli” shpk has not confirmed access/available the Line of credit. The Bank states that “will take in consideration the request if he fulfills the conditions of the bank”.
4.2.a) Specific Construction Experience. “Rukolli” shpk submitted only one contract “Construction of Millosheve – Vushtri lot 3” executed between 2013 – 2015, with value of 433,544,993 ALL VAT excluded. In this contract “Rukolli” shpk is partner of a JV with company “Bageri”. The percentage of participation of each partner is not declared.
4.2.b) Specific Construction Experience.
·         The Bidder fails to fulfill the sub-requirement for Piling Works. “Rukolli” shpk has submitted an agreement with a piling company “SOAL” and has declared the volumes executed by “SOAL”. The Bidder fails to fulfill the sub-requirement for Concrete Works: “Viktoria Invest Inernational” shpk has placed 25,259 m3 of concrete in 2013 as opposed to 36,000 m3 requested.
